APPLICABILITY: These Terms of Service apply to all curated travel services, private bookings, and individual consultations provided by On Pointe Travel, LLC. For Open Group Trips (trips marketed to the general public with set itineraries), please also refer to the Group Travel Policies posted at onpointetravel.net/group-travel-policies. In the event of a conflict between these Terms and the Group Travel Policies for a specific trip, the Group Travel Policies shall govern for that booking only.
This website is operated by On Pointe Travel, LLC. Throughout these Terms, the words "we," "us," and "our" refer to On Pointe Travel, LLC. By visiting this website or engaging any of our services, you agree to be bound by these Terms of Service, including all policies and notices referenced herein.
Please read these Terms carefully before accessing or using this website. If you do not agree to all terms and conditions, you may not access the website or use any services. Your continued use of the website following any changes to these Terms constitutes acceptance of those changes.
This website is hosted by Squarespace. Any new features or tools added to our services shall also be subject to these Terms of Service.
Section 1 — Online Terms & Eligibility
By agreeing to these Terms, you represent that you are at least 18 years of age. This website and its services are not intended for individuals under 18 years old.
You may not use our services for any illegal or unauthorized purpose, or in violation of any applicable laws in your jurisdiction. A breach of any of these Terms will result in immediate termination of your access to our services.
Section 2 — General Conditions
We reserve the right to refuse service to anyone for any reason at any time. We reserve the right to limit, modify, or discontinue any service or feature without notice.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of our services or website content without our express written permission. Credit card information is always encrypted during transfer over networks.
Section 3 — Accuracy, Completeness & Timeliness of Information
We are not responsible if information on this site is inaccurate, incomplete, or not current. Content is provided for general information only and should not be relied upon as the sole basis for making travel or financial decisions. We reserve the right to modify the contents of this site at any time without obligation to update any information.
Section 4 — Modifications to Services & Pricing
Prices for our services are subject to change without notice. We reserve the right to modify or discontinue any service at any time without liability to you or any third party. This includes, without limitation, our Professional Planning & Research Fee schedule, which may be updated periodically. The current fee schedule will always be posted on our website.
Section 5 — Travel Services
On Pointe Travel, LLC offers curated travel planning services including bespoke itinerary design, group trip coordination, cruise bookings, and related advisory services. All services are subject to availability and third-party supplier terms. We reserve the right to limit services to any person, geographic region, or jurisdiction.
We do not warrant that the quality of any travel services, information, or other material obtained through our services will meet your expectations. Travel involves inherent variability, and we cannot guarantee specific outcomes with respect to accommodations, transportation, weather, or other travel components.
Section 6 — Accuracy of Billing & Account Information
We reserve the right to refuse any booking in our sole discretion. You agree to provide current, complete, and accurate purchase and account information for all transactions. You agree to promptly update your information, including email address and payment details, so that we can complete your transactions and contact you as needed.
Section 7 — Payments, Fees & Cancellations
7.1 — Responsibility for Charges
You are responsible for all charges, fees, duties, taxes, and assessments arising from your travel bookings. By providing payment authorization, you authorize On Pointe Travel, LLC to act as your agent to purchase travel products from third-party suppliers on your behalf.
7.2 — Supplier Terms & Payment Deadlines
All payments for travel are due according to each supplier's payment schedule. Failure to make final payment by the specified due date may result in automatic cancellation and forfeiture of all deposits. On Pointe Travel, LLC acts as an intermediary for suppliers (airlines, hotels, cruise lines, tour operators, etc.) and is not responsible for any supplier's failure to perform, including bankruptcy, delays, cancellations, or injury.
7.3 — Travel Insurance
Travel insurance is strongly recommended. A policy can protect your investment against trip interruption, medical emergencies, lost baggage, and other unforeseen events. By proceeding with any booking, you acknowledge that you have been advised of the availability of travel insurance. If you choose to travel without insurance, you acknowledge that On Pointe Travel, LLC is not liable for any resulting financial losses, out-of-pocket expenses, or non-refundable supplier fees.
7.4 — Chargeback Policy
Excepting cases of proven fraud, you agree not to file any dispute or chargeback with your bank or credit card company regarding authorized charges, including disputes related to cancellations, changes, or circumstances beyond the control of On Pointe Travel, LLC or its suppliers. Any payment dispute must be resolved on an individual basis consistent with Section 28 (Class Action Waiver) and Section 30 (Arbitration). If you initiate an unauthorized chargeback, On Pointe Travel, LLC reserves the right to:
• Recover all associated merchant fees and administrative costs.
• Seek recovery of reasonable attorney fees and court costs.
• Cancel any remaining active bookings associated with your account.
7.5 — Professional Planning & Research Fees
On Pointe Travel, LLC charges non-refundable planning fees to cover the time, expertise, and global partnerships required to curate your travel experience. These fees are separate from the cost of travel components and are invoiced directly by On Pointe Travel, LLC.
• Curated Itinerary Fees: 7 Days or Less ($350); 8 to 14 Days ($500); 15 Days or More ($700 minimum). Groups larger than 8 travelers are subject to additional fees.
• Miscellaneous Fees: Group Cruise Bookings ($50 per person); Domestic Airline Bookings ($75 per person); International Airline Bookings ($100 per person).
• Complimentary Services: Single hotel, cruise, or tour bookings; travel insurance quotes; and payment plan applications.
All planning fees are 100% non-refundable regardless of whether the trip is eventually booked, canceled, or completed. These fees are considered fully earned at the time research commences.
7.6 — Administrative Cancellation Fee
In addition to non-refundable planning fees and any third-party supplier penalties, On Pointe Travel, LLC charges a non-refundable administrative cancellation fee of $250.00 per trip for any booking canceled after confirmation.
Section 8 — Third-Party Tools & Platforms
We may provide access to third-party tools and platforms — including booking systems, payment processors, and travel technology providers — over which we have no control. You acknowledge that we provide access to such tools "as is" and without any warranty, representation, or endorsement.
Any use of third-party tools offered through or referenced on our website is at your own risk. You should review and understand the terms of any third-party provider before engaging with their services. We may, in the future, offer additional tools or features through our website, all of which will be subject to these Terms of Service.
Section 9 — Third-Party Links
Our website may contain links to third-party websites, including supplier booking pages, partner agencies, and travel resources. These links are provided for convenience only. We are not responsible for the content, accuracy, or practices of any third-party website. Any transactions made through third-party websites are subject to their own terms and policies. Complaints or concerns regarding third-party services should be directed to that provider.
Section 10 — Client Communications & Content
When you send us communications — including trip preferences, reviews, feedback, or testimonials — you grant On Pointe Travel, LLC the right to use, reproduce, and share that content for business and marketing purposes, including on our website and social media channels, unless you expressly request otherwise in writing.
You agree that your communications will not violate any third-party rights, contain false or misleading information, or include any unlawful, abusive, or harmful content. You are solely responsible for the accuracy and appropriateness of any information you provide to us.
Section 11 — Personal Information
Your submission of personal information through our website or services is governed by our Privacy Policy, available at onpointetravel.net/privacy-policy. We collect and use your personal information to provide travel services, communicate with you, and fulfill our contractual obligations.
Section 12 — Errors, Inaccuracies & Omissions
Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to service descriptions, pricing, promotions, or availability. We reserve the right to correct any such errors and to change or update information at any time without prior notice. This includes canceling or modifying bookings if information was materially inaccurate at the time of booking.
Section 13 — Prohibited Uses
You are prohibited from using our website or services for any unlawful purpose; to violate any applicable laws or regulations; to infringe upon intellectual property rights; to harass, defame, or discriminate against any person; to submit false or misleading information; to upload malicious code or software; to collect personal information of others without authorization; or to interfere with the security of our website or services. We reserve the right to terminate your access for any violation of these prohibited uses.
Section 14 — Disclaimer of Warranties; Limitation of Liability
We do not guarantee that our services will be uninterrupted, timely, secure, or error-free. All services are provided "as is" and "as available" without warranties of any kind, express or implied.
To the maximum extent permitted by law, On Pointe Travel, LLC, its directors, officers, employees, affiliates, agents, contractors, suppliers, and licensors shall not be liable for any injury, loss, claim, or direct, indirect, incidental, punitive, special, or consequential damages of any kind, arising from your use of our services or any travel products procured through us. Because some jurisdictions do not allow limitations on liability for incidental or consequential damages, our liability in such jurisdictions shall be limited to the maximum extent permitted by applicable law.
Section 15 — Indemnification
You agree to indemnify, defend, and hold harmless On Pointe Travel, LLC and its affiliates, partners, officers, directors, agents, contractors, licensors, service providers, and employees from any claim, demand, loss, or expense — including reasonable attorneys' fees — arising out of your breach of these Terms, your violation of any law, or your violation of the rights of any third party.
Section 16 — Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law. The unenforceable portion shall be deemed severed from these Terms without affecting the validity and enforceability of any remaining provisions.
Section 17 — Termination
These Terms are effective unless and until terminated by either you or On Pointe Travel, LLC. You may terminate these Terms at any time by notifying us that you no longer wish to use our services. We may terminate your access at any time without notice if we determine that you have failed to comply with any provision of these Terms. All obligations and liabilities incurred prior to the termination date shall survive termination.
Section 18 — Entire Agreement
These Terms of Service, together with any applicable group travel policies, planning fee agreements, and privacy policy, constitute the entire agreement between you and On Pointe Travel, LLC regarding your use of our services. They supersede all prior or contemporaneous communications and agreements. Our failure to exercise or enforce any right or provision shall not constitute a waiver of that right or provision.
Section 19 — Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
Section 20 — No Professional Advice Disclaimer
The information available through this website, including destination guides, travel blog posts, and lookbook content, is provided for general informational and inspirational purposes only. It does not constitute professional legal, financial, medical, or travel advice specific to your circumstances.
You should consult appropriate licensed professionals — including your physician regarding health and vaccination requirements, and legal counsel regarding entry requirements, visa matters, or other regulatory questions — before making travel decisions. On Pointe Travel, LLC is not liable for any loss or harm arising from reliance on general informational content published on this website.
Section 21 — Service Outcomes & Expectations
On Pointe Travel, LLC makes every effort to curate exceptional travel experiences and to represent our services accurately. However, travel is inherently variable. Factors including weather, supplier performance, local conditions, and unforeseen events can affect travel outcomes in ways that are beyond our control.
We do not guarantee specific outcomes, experiences, or savings. Your satisfaction with any travel experience is dependent on numerous factors, including your own preferences, flexibility, and travel readiness. We encourage open communication throughout the planning process to ensure your expectations are well-aligned with your itinerary.
Section 22 — Testimonials & Reviews
Testimonials and client reviews displayed on our website represent the individual experiences of specific clients and are not a guarantee of what you should expect to experience. Results vary based on destination, trip type, travel dates, and individual circumstances.
On Pointe Travel, LLC accepts testimonials in good faith and publishes them to provide prospective clients with a representative sense of client experiences. We do not independently verify the specific outcomes described in any testimonial. Your experience may differ.
Section 23 — Copyright Infringement & DMCA Policy
On Pointe Travel, LLC respects the intellectual property rights of others and expects the same in return. If you believe that any material on this website infringes your copyright, please notify us at nadegenormil@onpointetravel.net. We will respond to all valid notices, including by removing infringing material or disabling links to infringing content. Repeat infringers will have their access terminated.

Section 27 — Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Subject to the mandatory arbitration provisions in Section 30, any dispute not resolved through arbitration shall be brought exclusively in the state or federal courts located in Suffolk County, New York. You irrevocably submit to the exclusive jurisdiction of such courts and waive any objection to venue.
Section 28 — Class Action Waiver
You and On Pointe Travel, LLC agree that any dispute resolution proceedings — whether through arbitration or litigation — shall be conducted solely on an individual basis. Neither party will seek to have any dispute heard as a class action, private attorney general action, or in any other proceeding in which either party acts or proposes to act in a representative capacity. No arbitration or proceeding may be combined with another without the prior written consent of all parties.
Section 29 — Seller of Travel Disclosures
On Pointe Travel, LLC is an independent affiliate of Fora Travel, Inc. Travel bookings are processed through Fora Travel, Inc., which holds the following Seller of Travel registrations:
• California: CST #2151992-50
• Florida: ST #43319
• Washington: SOT #604754510
Registration as a seller of travel does not constitute approval by the State of California.
Section 30 — Mandatory Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
30.1 — Agreement to Arbitrate
You and On Pointe Travel, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms of Service, the Group Travel Policies, or any services provided by On Pointe Travel, LLC — including any question of whether a dispute is subject to arbitration — shall be resolved exclusively through final and binding individual arbitration, rather than in court. This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.).
30.2 — Arbitration Process
Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in Suffolk County, New York, unless you and On Pointe Travel, LLC agree otherwise in writing. The arbitrator shall have exclusive authority to resolve all disputes relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
30.3 — Costs of Arbitration
Filing fees and arbitrator compensation shall be allocated in accordance with the AAA Consumer Arbitration Rules. Each party shall bear its own attorneys' fees and costs unless the arbitrator determines that a party's claim or defense was frivolous or brought in bad faith, in which case the arbitrator may award attorneys' fees to the prevailing party.
30.4 — Small Claims Exception
Notwithstanding the above, either party may bring an individual claim in small claims court in Suffolk County, New York, if the claim qualifies for small claims court jurisdiction and is pursued on an individual (non-class) basis.
30.5 — Waiver of Jury Trial
BY AGREEING TO ARBITRATION, BOTH PARTIES WAIVE THE RIGHT TO A TRIAL BY JURY. Disputes will be decided by a neutral arbitrator, not a judge or jury.
30.6 — Opt-Out Right
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to nadegenormil@onpointetravel.net with the subject line "Arbitration Opt-Out." If you opt out, any disputes shall be resolved in the courts specified in Section 27, and the Class Action Waiver in Section 28 shall still apply.
30.7 — Survival
This arbitration agreement shall survive the termination of your relationship with On Pointe Travel, LLC and any cancellation of travel services.
